The real money to be made from the HOA Gravy Train is from legal fees
and foreclosures. In most legal actions, both parties have something
to lose. Again, due to the perverse sense of justice, endemic to the
HOA universe, this is not the case. When I was a director of my HOA I
was protected by a $3,000,000.00 insurance policy. No matter what I
did, short of an outright criminal act, could I be held personally
responsible for my actions. When you combine that with a rapacious HOA
legal firm, the kinds of things that result truly staggers the
imagination.
If you were a board member, could you ever, ever in your wildest
dreams actually foreclose on one of your neighbors? I don't think if
you asked anyone that question they would say yes. If that's the case,
how does it happen?
I love the History Channel. Every now and then they do shows about the
concentration camps in Germany during World War II. One of the most
famous pieces of footage is where you see about 100 prisoners digging
their own graves and when they have finished the German soldiers shoot
them dead where they stand. The question I always had was, who are
those soldiers? When you look at the film they look like young kids,
18, 19, maybe 20 years old. How could they do that? Furthermore, if 2
or 3 or 4 years before that incident, you asked any one of them
whether he could see himself participating in something like that, how
many would answer yes? I don't think any of them would. So how do
things like that happen?
I think that as they often do, Hollywood provides an answer. In the
1974 movie, Chinatown, when Jake Gittes (Jack Nicholson) confronts
Noah Cross (John Houston) about him fathering his own granddaughter,
Noah Cross replies:
"See, Mr. Gitts, most people never have to face the fact that, at the
right time and the right place, they're capable of... anything!"
I think the same holds true for the board of a HOA. All the managers,
service providers, and legal firms need the board to believe in this
fraudulent "fiduciary responsibility" to the association, which itself
is nothing more than a legal specter, whose sole reason for existence
is to enable the HOA Gravy Train to remain on schedule. Any possible
consideration for the actual human beings who live in a community
governed by one of these aberrations has long since evaporated into
nothing, leaving behind only the scavengers to pick at the bones.
This "fiduciary responsibility" has to become a religion, because
without that blind conviction on the part of the board, the HOA Gravy
Train will derail and the money will stop flowing. That can never be
allowed to happen.
What about the resident who says, "I like the rules, they keep up
property values".
Cardinal Richelieu once said, "If you give me six lines written by the
hand of the most honest of men, I will find something in them which
will hang him". In a HOA everybody is guilty, of something. It's only
a matter of time before a confluence of events places virtually
everyone in the crosshairs, and then the CID industry starts to work
its magic.
Is it a conspiracy? No, I think "Grand Falloon" would be a closer
description. A grand falloon is a collection of people or groups that
have no prior knowledge of, or relationship with each other, yet act
in cooperation to achieve a shared goal. Think of it as the crew who
runs the HOA Gravy Train.

Since the beginning which can be traced back to at least since February of 1999. There were many things that were problems back then. There were no fire hydrants and there was a lump at the entrance of this building that damaged the firetruck that came to the building.These are just two points of the problems. But what if the building was not in that location and they didn't run into those problems, I don't think as many units would have been affected. I read it was 6-8 units that were damaged badly and some gutted all together. I think it was a West Lawn Borough issue with zoning building and such.
Can anyone see that there appears to be ties between the township, hoa and management co? I see it clearly and it causes me grave concern. I strongly believe that this is contaminated land and that is why the DEP and Township codes guy claimed they could not find the sinkhole. This is one huge coverup and many entities appear to be involved.

A developer stated "I am a developer, and these kinds of mold problems, depending on the mold are life threatening; and the people should be compensated and the building should be torn down properly, not to leave or cause another issue that ends up happening with these situations."
A retired engineer has stated, "it would appear there has been significant shifting in the foundation. This can be from a number of problems or combination of problems. Inadequate drainage of the ground the footers were erected in, improper footers, concrete of insufficient strength, etc. Because of ground moisture getting into every nook and cranny of the building I would say the entire building is a hazard from mold and moisture, not just a single unit.

We already know that there was cross contamination by the reports of discolored water, rotten egg like oder, discoloring of clothing, slimy texture if water too. Why would you need iron tablets? These a few points just a few points. Then know that the sewage was coming out of the kitchen sink in a volcanic like manner and sewage filtration in areas where water perturbed. There witness to all of this and after research it would conclude that there was cross contamination. Maybe that it was all the delays are all about, trying to coverup the issue at hand.
Here is another thought... There was reported little red worms in the water so wouldn't that indicate further and solidify the fact that there is contamination. I think someone did testing and they don't want anyone to know the results. COVERUP!

1. Air- dryer vent buckets, mold and mildew, legionaries disease, drywall, insulation possible asbestos.
2. Water- It was reported as slimy, discolored, egg like oder, orange staining of clothing.
3. Soil - the side of the bottom of the east end of the building has orange discoloration and could be lead or sewage.

3. Berks County Health Department states that the township is responsible for issue like mold, because they only do vaccinations. Yet, the township claims they don't have any policies set up for that?

You cannot trust that township! They dance around questions and have not enforced the rules and regulations at that building. If the codes guy was doing his job then there would have been permits for the work that was being done at that building. You can look at the pictures and see many code violations. I think the building should be condemned.
The Township Code Enforcement Officer stated that due to the way the building was built (i.e. into the side of the hill) and that it was not build properly, you would have to live with water intrusion, moisture, and their effects, including mold.
The water not only was slimy, discolored and smelled like rotten eggs but it had little red worms. These are all signs that point to cross contamination. You need water for daily living and this person was suppose to pay for contaminated water in their HOA fees? Add cleaning up the sewage that was coming up in a volcanic manner out of their kitchen sick and other areas then know they are paying for this in their HOA fees too. You are suppose to pay to clean up others raw sewage? NOW TELL ME THAT ITS LIVABLE! YOU CANNOT!
The condo has railroad ties that are placed up against the sides of the building. Someone said they thought they were on the east and west end to keep the grounds from caving. They fixed the west end but not east! I think we know that the east end can not be fixed.

Judson Witham, a building construction expert with more than 40 years of experience, explains the dangers at the Hidden Valley condos in Spring Township, Berks County, PA. He explains that he would like to see the construction records and all the records on the building, but the problem is Berks County and the Township is insisting that they need subpoenas for him to see the records which he says is absolute nonsense because they are public record. Judson says, ?The Township and the county, the State of Pennsylvania is violating the law when they prevent people access to those building plans and those inspection reports. A few shocking facts about the condos:
1) The exterior structural sidewall wall (4 stories high)next to the street, fell down during a wind storm -- (November 1989).
2) Fire originated in unit "D"- that damaged (6-8) units- - (February 1999).
3.) Fire originated in unit "V" - (April 2011). One man is dead as a result of this fire.
4) The building is heavily contaminated with mold.
5) The building is has numerous stairway and structural cracks and sinking.
6) There is a sinkhole adjacent to the building.
7) Dryer buckets are being used. This is a Federal violation.
There are many more dangers with the building.
9) Required files are MISSING at the township, management company and the hoa/board members. Among them are MISSING incident reports and permits. (COINCIDENCE?)
10) Work has been done at this building and there are no permits posted or on file. You don't know what work is being done or if the workers are qualified.
This is a very sad situation for all those involved in Berks County, Pennsylvania, especially for those whose health and safeties are in danger.

1) The exterior structural sidewall wall (4 stories high)next to the street, fell down during a wind storm -- (November 1989).
2) Fire originated in unit "D"- that damaged (6-8) units- - (February 1999).
3.) Fire originated in unit "V" - (April 2011). One man is dead as a result of this fire.
4) The building is heavily contaminated with mold.
5) The building is has numerous stairway and structural cracks and sinking.
6) There is a sinkhole adjacent to the building.
7) Dryer buckets are being used. This is a Federal violation.

9) Required files are MISSING at the township, management company and the hoa/board members. Among them are MISSING incident reports and permits. (COINCIDENCE?)
10) Work has been done at this building and there are no permits posted or on file. You don't know what work is being done or if the workers are qualified.
This is a very sad situation for all those involved in Berks County, Pennsylvania, especially for those whose health and safeties are in danger.
