The Urban Redevelopment Law grants the power of eminent domain for the specific purpose of eliminating "blight"
1) Unsafe Dwellings
2) Overcrowding of dwellings
3) Excessive land coverage of buildings
4) Lack of proper air, light and proper space
5) Defective design and arrangement of buildings
6) Faulty lot or street layout
7) Economically or socially undesirable land uses
**** How many can you count at HV that would qualify for Condemnation? *****

WHO IS PROTECTING WHO?
1. If codes did their job there would not be dryer vent buckets in the units.
2. There would be paperwork for the changing the ventilation.
3. Berks County Health Department states that the township is responsible for issue like mold, because they only do vaccinations. Yet, the township claims they don't have any policies set up for that?
4. The code guy claims he does not know who owned the land in the wooded area next to the condo? Yet, he was the person who signed off on sewer work? (He holds zoning and wouldn't you need to know who's property you are doing this on?
5. Maybe the work was not completed, recall that they could not get a backhoe in the wooded area.
6. The codes guys job description includes that he does testing of soil. Yet, he has NOT done this either even though requested with good cause.
7. The codes guy did not even block of there wooded area even though he claims an autistic child was playing in that area.
8. The codes guy can't even find the sinkhole nor can the DEP guy? How is it that others have been there seen it and there are pictures and video to verify there is.
9. The codes guy laughed and said he heard that when informed that the building was rumored to built on contaminated land.
10. How can you you air out a condominium with two windows that are next to the sewers? You would be breathing in methane and sulfur gases to name a few. (They cause mold!!!!)

The article informs people to notify those in gov positions and to give it to them This was done but still nothing has been done regarding the pervasive mold in this
This building has undeniable moisture problems. Being that it's built into the side of a hill and that many units are below ground level is an issue. People do not live under the ground level normally. Who allowed this building to be built at this location? Who signed off on the work? Where is all the paperwork and why is it missing from all the places it should be? http://www.veteranstoday.com/2014/05/26/toxic-mold-epidemic-in-am

A developer stated "I am a developer, and these kinds of mold problems, depending on the mold are life threatening; and the people should be compensated and the building should be torn down properly, not to leave or cause another issue that ends up happening with these situations."
A retired engineer has stated, "it would appear there has been significant shifting in the foundation. This can be from a number of problems or combination of problems. Inadequate drainage of the ground the footers were erected in, improper footers, concrete of insufficient strength, etc. Because of ground moisture getting into every nook and cranny of the building I would say the entire building is a hazard from mold and moisture, not just a single unit.

We already know that there was cross contamination by the reports of discolored water, rotten egg like oder, discoloring of clothing, slimy texture if water too. Why would you need iron tablets? These a few points just a few points. Then know that the sewage was coming out of the kitchen sink in a volcanic like manner and sewage filtration in areas where water perturbed. There witness to all of this and after research it would conclude that there was cross contamination. Maybe that it was all the delays are all about, trying to coverup the issue at hand.
Here is another thought... There was reported little red worms in the water so wouldn't that indicate further and solidify the fact that there is contamination. I think someone did testing and they don't want anyone to know the results. COVERUP!
I would not accept someone telling me to use lemon and vanilla to cover the stench from my kitchen sink. It is apparent that they were aware the homeowner was experiencing sewer backups and sewer gas permeation as well.. Another example of how problems are dealt with improperly.

REASONABLE CAUSE FOR TESTING
1. Air- dryer vent buckets, mold and mildew, legionaries disease, drywall, insulation possible asbestos.
2. Water- It was reported as slimy, discolored, egg like oder, orange staining of clothing.
3. Soil - the side of the bottom of the east end of the building has orange discoloration and could be lead or sewage.

DO YOU KNOW THAT WHEN YOU TYPE IN THE ADDRESS ON GOOGLE FOR -1334 WEST WYOMISSING BLVD- IT COMES UP AS A POOL ? When you look up the address for Hidden Valley Condominiums - 1334 West Wyomissing Boulevard, West Lawn, PA 19609- that address show's up as a pool! It shows up at Lincoln Park Pool. You can go to several search engines and the address shows a pool...
The water not only was slimy, discolored and smelled like rotten eggs but it had little red worms. These are all signs that point to cross contamination. You need water for daily living and this person was suppose to pay for contaminated water in their HOA fees? Add cleaning up the sewage that was coming up in a volcanic manner out of their kitchen sick and other areas then know they are paying for this in their HOA fees too. You are suppose to pay to clean up others raw sewage? NOW TELL ME THAT ITS LIVABLE! YOU CANNOT!
There are so many code violations that I have, there are too many to list! Just to name a few: visible mold, structural cracks, dryer vent buckets, the sewer too close to the building, the trash dumped in the woods adjacent to the building, the tree by the east wall is too close plus covering the meters, no handicapped accessibility, major sidewalk cracks, poor ventilation, no fire escapes, only one exit per unit when there should be at least two, the windows on the end units are stationary and should be removable to escape a fire, there should be a building-wide fire alarm system, cracks in the basement, wires in the basement painted white- you can't even read what they are and what they're for, work done with no permits, obvious moisture damage to numerous areas in the unit, raw sewage coming up into the sinks and toilet.... the whole unit and the whole building is a code violation in itself!!!
I just read this post from someone and thought I would share it.
HOA's are regulated by The State. However, no matter what, the unit owners will wind up footing the bill for the building unless the HOA and the builders are deemed egregiously at fault to the point of committing criminal negligence. Find a lawyer in Reading, trust me there's plently who'd love this. But I'm telling you, you're owners, it will become your financial responsibility. Have you considered forced Eminent Domain? States can seize properties over these acts.

In regards to the Spring Township Codes Enforcement Officer not doing his report 72 days after a preliminary inspection of the property:
This is truly outrageous that it's delay after delay when it's clear to even a 5 year old that this place is disgusting! How can you not take notes when you're at a property to do an inspection? How do you not take a multitude of pictures to document every nook and cranny and then dissect the pictures later like we did with ours? How do you not test the soil/air/water when requested to do so, even after making a joking comment about hearing the property was on contaminated land? How do you not block off the woods when requested to do so with all that debris in there, even after making a comment about hearing about an autistic child playing around there? How do you not let the other residents know about the mold in the "basement"/storage area? How do you not leave notes on the units' doors asking them to contact you if they have dryer vent buckets in use because they're harmful & illegal? How do you not get a report done in a timely manner and start the ball rolling on doing something about condemning this property?
I'll tell you why.... Because HE DOESN'T CARE! He's collecting his nice fat paycheck for his 3 job titles (which apparently he doesn't even know the job descriptions of) and just sits around on his laurels and makes excuses for not doing his job. Well, once this gets out to the media, we'll see how long he has that nice, comfy job position after everyone hears that he's collecting taxpayers' money to do ABSOLUTELY NOTHING! THIS MAN IS A DISGRACE TO THE TOWNSHIP AND THE RESIDENTS IN IT!!! How does he sleep at night knowing that all these people in there are breathing this crap in and is doing God-only-knows-what to their bodies? He needs to be called out and soon!

Wyomissing says...
Another main concern we should all have is the retaliation that will be placed against the homeowner for being a whistle blower.
There is no acceptable reason to wait over 2 months for a report from the township! People have to know there is a major problem with that building and that it is in no way up to code!
Christian Leinbach's office is waiting to hear back from the Township, which is minimal effort. He should take the lead. The fact that he is waiting for a response indicates to me that he sees issues that should be addressed. If the building was up to code and safe, he wouldn't have to wait for anything.
Representative Gillen's response that he is working on the budget is the consummate beaurocratic company line when an unfamiliar problem is staring him in the face. Learn how to multi-task and use your staff that we are paying for to get things done. Be the hero and look out for the people that are living in this building's conditions.
MY THOUGHTS -
Representative Gillen - Still working on budget. - (An absolutely pathetic excuse!)
Commissioner Lienbach - Waiting to hear back from the township.- (Should be involved and overseeing this matter.)
EPA/DEP - Waiting for return response.- (Nothing positive)
Berks County Health Department- Can't help; they only do immunizations.- (Normally this is not the case.)
Township of Spring - Still waiting on their report. - (Buying time to cover their butts!)
*All entities that have been contacted claim that it's the Township's responsibility.
